Welcome to Paper Petals Design and Artwork Studio. These Terms of Service ("Terms") govern your use of our website (thepaperpetals.com) and the purchase of our products. By accessing our store, you agree to these Terms.

SECTION 1 - ACCESS AND ACCOUNT

To use our Services, you may be asked to provide information such as your email, billing, and shipping address. You represent and warrant that all information you provide is correct, current, and complete. You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, or assign your account to any other person.

SECTION 2 - ACCURACY OF INFORMATION

Product Descriptions: We aim for 100% accuracy. However, as many of our products are handmade, slight variations in color, texture, and "cut alignment" may occur. These are not considered defects but are part of the "small details" that make our products unique.
Our Products: We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
Changes & Availability: All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person.
Errors: Occasionally, information may contain typographical errors or omissions. We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. Paper Petals reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Paper Petals confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Paper Petals may be unable to accommodate cancellation requests after an order is accepted. Your purchases are subject to return or exchange solely in accordance with our Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES AND BILLING

Pricing: All prices are listed in UAE Dirhams (AED). Under UAE law, the price you see at checkout is the final price.
Taxes: In accordance with UAE Federal Tax Authority regulations, prices are inclusive of VAT where applicable.
Promotions: Prices, discounts, and promotions are subject to change without notice. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
Payment Accuracy: You agree to provide current, complete, and accurate purchase and account information. You represent and warrant that: (i) the credit card information you provide is true and complete, (ii) you are authorized to use it, and (iii) you will pay the charges incurred, including shipping and handling.

SECTION 5 - SHIPPING AND DELIVERY

We ship from our studio in Dubailand, Dubai.

Estimates: We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control.
Risk of Loss: Once we transfer products to the carrier, title and risk of loss passes to you.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including all trademarks, brands, designs, sticker artwork, "Snuggle Stories" branding, text, and images, are owned by Paper Petals Design and Artwork Studio and protected by UAE and international copyright laws.

These Terms permit you to use the Services for your personal, non-commercial use only.
You must not reproduce, distribute, modify, or create derivative works of our material without our prior written consent. All rights not expressly granted are reserved by Paper Petals.

SECTION 7 - THIRD-PARTY LINKS AND OPTIONAL TOOLS

We may provide access to third-party tools (like Shopify apps) or links to third-party websites. We neither monitor nor have control over these. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Please review the third-party's policies carefully before you engage in any transaction.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

Paper Petals is powered by Shopify. However, any sales and purchases you make in our store are made directly with Paper Petals. You agree that Shopify is not responsible for any aspect of sales between you and Paper Petals, including any injury, damage, or loss. You hereby release Shopify and its affiliates from all claims and liabilities arising from your transactions with Paper Petals.

SECTION 9 - FEEDBACK

If you submit ideas, reviews, or plans ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and display such Feedback in any medium for any purpose, including commercial use. We are under no obligation to maintain Feedback in confidence or pay compensation for its use. You are solely responsible for the accuracy of any Feedback you make.

SECTION 10 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services for any unlawful purpose, to infringe upon our intellectual property, or to harass, abuse, or harm others. You agree not to upload viruses or malicious code, or to "scrape" or crawl our Services. We reserve the right to terminate your account for violating any prohibited uses.

We may terminate this agreement or your access to the Services at any time without notice. Upon termination, you remain liable for all amounts due up to the date of termination.

SECTION 12 - DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

The Services and all products are provided 'as is' and 'as available' for your use, without any warranties or conditions of any kind. To the fullest extent provided by law, Paper Petals, Shopify, and our respective affiliates shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind, including lost profits or lost data, arising from your use of the Services or products.

SECTION 13 - INDEMNIFICATION

You agree to indemnify and hold harmless Paper Petals, Shopify, and our affiliates from any claims or legal fees arising out of (1) your breach of these Terms, (2) your violation of any law, or (3) your use of the Services.

SECTION 14 - SEVERABILITY AND ENTIRE AGREEMENT

If any part of these Terms is determined to be unlawful or unenforceable, that part shall be severed, and the rest of the Terms shall remain valid. These Terms constitute the entire agreement between you and Paper Petals, superseding any prior agreements.

SECTION 15 - GOVERNING LAW

These Terms of Service shall be governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai. You and Paper Petals consent to the exclusive jurisdiction of the Dubai Courts.
